A01 Existing AIFC law Enabling law
AIFC legal framework & Constitutional Statute
AIFC law is a special regime anchored in Kazakhstan's constitutional order, based on English common-law principles. It is the precedent for how a centre obtains delegated rulemaking — it has no legal force in Viet Nam.
A02 Existing AIFC law Licensing
Financial Services Framework Regulations (FSFR)
Separates authorisation for Regulated Activities from authorisation for Market Activities (operating an exchange or clearing house). AFSA approves an AMI's business rules separately. Client-asset protection and enforcement are separate regimes.
A03 Existing AIFC law Licensing
General Rules (GEN)
Schedules define which instruments are Specified Investments — the first gate for classifying any token.
A04 Existing AIFC law Digital assets
AIFC Glossary (GLO)
Classification turns on these definitions. A token can fall into different categories depending on the rights it carries.
A05 Existing AIFC law Exchange & clearing
Authorised Market Institution Rules (AMI)
Investment Tokens are traded and cleared on regulated market infrastructure with DLT-specific controls — not under the crypto-asset regime.
A06 Existing AIFC law Commodity
Multilateral & Organised Trading Facilities Rules (MOTF)
Whether a meat or seafood token is a Qualified Investment Token is fact-dependent (contract terms, delivery, settlement). Nothing in MOTF makes such a token licensed automatically.
A07 Existing AIFC law Securities
Market Rules (MAR)
Security tokens carry full securities disclosure duties; tokenisation does not reduce them.
A08 Existing AIFC law Securities
Dematerialised Investments Rules (DEM)
Shows how the legal register — not only a ledger entry — determines who owns an investment.
A09 Existing AIFC law Digital assets
Rules on Digital Asset Activities (DAA)
A separate regime from AMI/MOTF. Choosing DAA vs AMI vs MOTF depends on token classification, not preference.

Rules on Providing Money Services (PMS)
Settlement tokens and cash legs may be money services rather than investments.
A13 Existing AIFC law AML / FinTech
AML/CFT rules (AFSA rulebook, AML module)
Token venues are high-risk for AML; obligations apply to issuers, venues and custodians.
A14 Existing AIFC law AML / FinTech
Financial Technology Rules (FinTech Lab rules)
Shows a sandbox with hard caps and exit plans — not a waiver of law.
A15 Existing AIFC law AML / FinTech
AFSA FinTech Lab
Practical sandbox model.
A16 Existing AIFC law AML / FinTech
AFSA FinTech authorisation process
Shows documentary evidence a regulator expects before testing.
A17 Existing AIFC law Licensing
Recognition Rules (REC)
Recognition is a discretionary AIFC decision. It is not a passport; Viet Nam would need its own recognition basis.
A18 Existing AIFC law Securities
Collective Investment Scheme Rules (CIS)
A pooled commodity token may accidentally be a fund.
A19 Existing AIFC law Licensing
Fees Rules (FEES)
Budget input for licensing in Kazakhstan, if an AIFC entity is used.
A20 Existing AIFC law Private law
AIFC Companies Regulations
Relevant if the Kazakhstan-side issuer or SPV is an AIFC entity.
A21 Existing AIFC law Private law
Special Purpose Company Rules
Bankruptcy-remote holding of goods or receivables for token holders.
A22 Existing AIFC law Private law
AIFC Contract Regulations
Token transfer terms may be AIFC-governed, but this does not transfer property in goods located in Viet Nam.
A23 Existing AIFC law Private law
AIFC Security Regulations
Relevant to trade finance tokens secured on goods or receivables.
A24 Existing AIFC law Private law
AIFC Data Protection Regulations
KYC and supply-chain data will flow Kazakhstan ↔ Viet Nam.
A25 Existing AIFC law Payments & FX
AIFC Rules on Currency Regulation

A26 Existing AIFC law Exchange & clearing

A27 Existing AIFC law Exchange & clearing
AIFC Netting Regulations
Essential for CCP and derivatives clearing.
A28 Existing AIFC law Disputes
AIFC Court regulations & rules
AIFC Court judgments are not automatically enforceable in Viet Nam.
