Provisions / sections
s 3 (territorial application), ss 13–18 (definitions and perimeter of Authorised Firm, Market Institution and Regulated Activities), s 24 (General Prohibition on carrying on Regulated, Market or Ancillary Activities without a licence), ss 27–28 (financial promotions and enforceability), ss 30–38 (licensing of Authorised Firms and Authorised Market Institutions), s 32 (FinTech waiver/modification of requirements), ss 51–53 (preparation of AMI Business Rules, AFSA approval and their contractual effect), s 92 (definition of Collective Investment Scheme — not general rulemaking).
Legal significance
Separates authorisation for Regulated Activities from authorisation for Market Activities (operating an exchange or clearing house). AFSA approves an AMI's business rules separately. Client-asset protection and enforcement are separate regimes.
Proposed VIFC adoption action
Proposed adaptation Use as the structural template for a VIFC licence matrix that separates venue, clearing, custody, broker and payment permissions.
Original-language caveat
Original text in English; AIFC law applies only within the AIFC (Kazakhstan). Not operative in Viet Nam.
